What is Workers' Compensation? - Duration: 1:20.

Workers' comp is nothing more than just a compromise between the employer and the employee.

Now, remember who wrote the act, it's not the employees who wrote the act, it's the

employers and their lobbyist.

But, it's supposed to be a compromise where the employee, if they get hurt at work, will

get medical treatment right away.

In exchange for that, the employee cannot sue the employer for negligence.

That's a compromise that's supposed to be there.

The benefits will be limited to whatever has been injured to, but the compensation, you

don't get pain and suffering.

You don't get anything like you would in a normal negligence case.

What you get is, if you could work this many jobs before, well, what's the impact of the

injury now?

How many jobs can you now work?

We're you at full duty before, and now you're limited to light duty?

Let's compensate somebody for that difference.

That's what workers' comp is in, I could go and explain a lot further, but basically,

it is truly a compromise, between the employer and the employee.

What If I Can't Return to Work? - Duration: 1:29.

So if the injured employee cannot return to work for a certain period of time and then

later on returns to work, that is temporary total disability.

In that instance, you look at the person's average weekly wage, they'll get two thirds

of that for that period of time.

Now, your question would be what happens if you just say, they cannot go back to work

at all.

I mean, for the rest of your life, they cannot return to work.

Then it'll be two thirds of their average weekly wage for the rest

of their lives.

Good afternoon and welcome to this edition of Alabama Law TV.

My name is Cindy Speaker.

I have with me today attorney Nathan Guin from Gardberg and Kemmerly, Attorneys at Law.

They're located headquartered in Mobile, Alabama.

They handle veterans' disability cases throughout the country.

Nathan, thanks for being with us Thank you for having me again.

I always enjoy it and glad to spread some good information to our veterans.

Yes, it's very helpful.

We've got an archive for those of you watching now.

There's an archive of information on Facebook, the videos on Facebook.

Nathan has presented many times on various aspects of veterans disability law.

Very, very helpful.

Today we're gonna talk about a new topic, one that I'm not familiar with, and that is

lay evidence.

Why don't you start off telling us, what is lay evidence?

What constitutes lay evidence in a veterans disability claim?

Okay.

In a veterans disability claim, lay evidence is basically any evidence and all evidence

that is not medical.

If you have a statement from the veteran, a statement from his family members, friends,

people that they served with, any statement regarding the veteran's condition or things

that happened in the past, anyone who's not a medical professional but would have personal

knowledge regarding the veteran's either current condition or in service injury, things like

that.

It'd be any kind of non-medical expert that can provide some kind of information that's

pertinent to the claim.

In what types of cases is that valuable for claims?

They're valuable in all cases.

I think that sometimes it's undervalued.

I think a lot of times they're used for service connection, which is really helpful, especially

when you have Vietnam veterans, things like that, where if you're in the jungle there's

not a lot of good record-keeping.

What are the VA's duties regarding the evaluation and analysis of lay evidence?

They're required to consider all lay evidence.

They have to assess the credibility and they can weigh it in any way they see fit.

They just have to give you reasons and bases for how they weigh that evidence.

They also can't just dismiss.

There's certain levels of consideration they have to give.

For example, just because there's no contemporaneous or medical evidence that confirms what the

lay evidence says or there's not any documentary evidence other than the statement of either

the veteran or whoever it may be, they can't just dismiss that out of hand.

They can't say, "Well, there's nothing else to support that.

Therefore, the lay evidence is not privative.

It's not credible.

There's nothing we can do there."

They have to give it a good bit of deference and really have to look into it.

Now, they can analyze it for negatives, too, which I think we can get into in a little

bit.

But they really have to treat it as if it's any other piece of evidence, medical evidence

or otherwise.

They have to give it its full consideration, even if the record doesn't necessarily bear

out or confirm or corroborate, which is not probably the best word, but what's being said

in the statement.

Yeah.

When is the best time to develop the lay evidence?

Anytime is good.

The earlier the better, especially the way things are now and, I guess, even the way

they will be.

The earlier you can get evidence in, I think, is always the best because when you start

at the beginning, that's when you can maximize your opportunities in terms of how many times

you can appeal, how many different people can lay eyes on a particular piece of evidence.

There's no time that's too early.

You can get lay evidence even when you file it and file it with your original claim.

You don't have to wait until you get denied.

You wanna get that in the hands of somebody who can see it as quickly as possible.

As you're going along, if you think about it, just even in passing on a regular basis,

this person may be able to get some information.

At any point, it's valuable but the earlier, I would say, the better.

Yeah.

It brings up another point, as with all of these claims.

It's so important for the veteran to be documenting things, right?

Absolutely.

Documenting everything that you can, you don't have to write it down, but just remembering

things functionally around the house that you can't do, especially when you go see your

doctors.

A lot of the times, at any given appointment, you can be having a better day than any other.

It may not be borne out in the records what the real disability picture is.

Documenting different things and having people in your life that maybe have a more objective

view.

I know that if you ask me and my wife to write down what was wrong with me and ask her to

write the same thing, we'd probably come up with completely different answers.

Hers might be more extensive than mine.

That's the case with veterans claims, too.

A lot of times we don't wanna see things in ourselves that we don't wanna see, so we have

to rely on other people to put that out there for us.

That's a great point.

That's a great point.

What challenges can the VA bring to reduce the credibility or value of lay evidence?

They can evaluate it for, basically, bias.

They can affect the credibility if they think that you're really just, for lack of a better

term, hamming it up just to help out whoever it is you're trying to help out.

They can look at it from a critical perspective, but they still have to give you a reason or

basis for how they weigh your evidence.

If they think it lacks credibility, why does it lack credibility?

But they can always, just because they have to consider it doesn't mean they can't discount

it, but they have to really point to a concrete reason as to why that lay evidence is either

not credible or fraudulent or embellished, whatever you wanna say.

They can look at it as of course anything else, too.

Yeah.

Complicated stuff.

It is.

I wish that we could go for hours on some of this stuff, so hopefully I'm getting some

good information out there because we could really get in the weeds pretty quick on some

of this stuff.

Yeah, yeah.

Principle #11 - Water Supply - Duration: 2:25.

NPIP Biosecurity Principle #11 is water supply. Your source of

water on your farm determines the level of disease risk associated with it. Your

biosecurity plan needs to describe your water source and what type of treatment

plan is practiced. Are you using a municipal water source? A private well on

your farm-site? Or are you using surface water to provide drinking water for your

birds, cleaning and disinfecting purposes or possibly even using it for heating or

cooling? If you have a municipal connection or a private well on your farm

site, your biosecurity plan can include a statement as simple as: "All farms are

only allowed to use water from a well source. No surface water is allowed to be

used for any purpose", for example. If you do use surface water on your farm for

any function you need to provide the treatment plan for that water to prove

that you are removing microorganisms and further disease risks. If you do not have

a treatment plan for the use of that surface water you need to be able to

provide materials that support you have a risk assessment in place. These risk

assessments do not need to be peer reviewed or implemented or created by a

professional organization. However, they do need to be very thorough and consider

all water management practices. NPIP Biosecurity Principle #11 is water

supply. Employing a biosecure water management plan on your farm can improve

your flock's health and help reduce risk. In your biosecurity plan list your

source of water and the treatment plans that are practiced. If you are using

surface water for any function be sure to include that complete treatment plan

and any risk assessments you have in place in order to minimize disease risk

from your water source.

Barack Obama hates the fact that Barack Obama is no longer the occupant of the White House.

The two-term squatter who single-handedly caused more destruction to this country than

anyone before him, has spent the last year acting as if he's still in office and people

actually care what he thinks.

Between shadowing President Trump on his overseas tours, offering his unsolicited opinion on

national issues, and undermining Trump at every turn, it's evident he still hasn't

accepted the results of the last election.

On Tuesday evening, this was again reinforced, when he went on a totally unhinged rants about

President Trump and compared him to Hitler's rise in Germany, because putting America first

and looking out for all of our people is somehow the equivalent of gassing millions of people

and trying to take over the world, or something.

According to Newsbusters, Obama was speaking to the Economic Club of Chicago with Mellody

Hobson when he made the bizarre and inflammatory remarks about our President.

According to Obama, the "nativist mistrust and unease" sweeping across the country

is similar to what Germany experienced when Hitler rose to power, so people should be

afraid even though we knew who Trump was when we voted for him.

"The danger is grow(ing) complacent," Obama said.

"We have to tend to this garden of democracy or else things could fall apart quickly."

That's what happened in Germany in the 1930s which, despite the democracy of the Weimar

Republic and centuries of high-level cultural and scientific achievements, Adolf Hitler

rose to dominate, Obama noted.

"Sixty million people died….So, you've got to pay attention.

And vote."

Right.

First off, it was six million people who were killed under Hitler, not 60 million – the

communist ideology Obama seems to love is what killed nearly 100 million people in the

last century.

Although to be fair, the entire death toll from WWII is estimated to be between 40 and

50 million people, so there's that.

But I digress.

Even the writer for Newsbusters couldn't get over the outrageous nature of Obama's

comments about the President, writing "No surprise either that Obama didn't appear

to get pushback for this comment from his personal friend and financial backer, who

just happened to be his interviewer, Mellody Hobson.

Hobson is not just a financial contributor for CBS, but is a close friend and high profile

donor to Obama's two presidential campaigns."

Meanwhile, the same Mellody Hobson was called a "great friend" by Obama in 2013 during

a White House event, so it's no wonder she didn't push back against his ridiculous

comments – she likely believes them to be true.

Of course, this isn't the first time the left has compared President Trump to Hitler,

either.

In November, the Independent wrote a piece in which the duly-elected President of the

United States was likened to the leader of the Third Reich, keeping it classy as always.

"If the president could order the FBI to investigate Hillary Clinton, where would it

stop?

Anyone who spoke out to criticise such a brazen act would be vulnerable to the same treatment.

And then any individual or any group — regardless of whether they had actually done anything

— would be at the mercy of Trump's politicised justice system.

The President would be able to exclude anyone he wished from the national community.

The road to dictatorship would be wide open to him.

We know this because it was such a system that helped destroy democracy in Germany and

helped Hitler establish his Nazi dictatorship."

These people are absolutely unbelievable.

President Trump is our President.

He won.

You lost.

Get over it already.

have carpet, carpet cleaner and these are just really like off the top of my head

what I could think of that we use but Young Living also has vitamins. They have

energy drinks. They have snacks. There are so so many things that you can use to

fill your monthly box and fill it with clean products that you know are going

to be good for your family and all you need to do is purchase $50 a month and

like I said you get back the first one to three months, you get back 10%. From

month four to twenty four, you get back 20% and then from twenty four months on

you get back twenty five percent and you get that back and you can either allow

Does Your Team Have A Code Of Honor? - Duration: 3:31.

Have you recently added people to your team?

Just one problem, that tight, cohesive, coherent team that used to do amazing things

is now starting to struggle, fall apart, and stab each other in the back.

Well, in this video I'm gonna show you how to get rid of that and how to get your team back the way it used to be.

Hey, it's Jason from highperformancesalon.com and here's the deal.

If you are growing that is a great thing.

But it can also be extremely painful.

Like think about this have you ever been to the gym and worked out and pumped iron

or worked out on your legs, something like that and the next day you couldn't move

because your body's building muscle but it's extremely painful.

Now it's a good thing to do to actually grow muscle and go to the gym and build yourself up just like it is inside the salon.

But the problem is it's painful so most people probably including me and you avoid doing it as often as we should.

So if you've hired new people on your team and it's starting to become painful

meaning that you're breaking systems and they're having issues

and you're starting to create communication backstabs

well you gotta figure out what the problem is.

And one of the things that we teach inside our High Performance Salon Academy

is you have to have something called a code of honor.

Now a good friend of mine named Blair Singer created the code of honor and talks

about how do you actually implement a set of rules that's created by the team, for the team to actually govern the team?

Now a couple things about the rules.

They've gotta be created in 10 items or less maybe 12 at the most and the whole team needs to agree to it and create it.

This is not a list that you simply hand to your team and say follow.

So what if you bring somebody new on and they are not familiar with your code of honor?

Well firstly before you even hire them you should review your code of honor.

So for example if your code of honor says be on time it might be a good practice for you to say

What does being on time mean to you?

Wait for them to give you their answer

and then give them the answer that your salon operates from.

Because maybe being on time doesn't mean just you're in the building, but it actually means

you're sitting down with a guest ready to cut their hair at the exact moment of their appointment.

These are really important distinctions that you should hear from people before you hire them.

Now let's say you've got people on and things are starting to get sideways.

Things aren't working the way that you should.

What I encourage you to do is get together with your team

and actually have a code of honor revisit meeting.

This doesn't mean you're gonna rewrite your code of honor.

It just means you're gonna sit down and clarify.

So what you wanna have happen is have each person on the team read one of the items on the code of honor

and just say what does that mean to them.

And make sure that everybody is on the exact same page.

If you do this, and we did this in our office just recently

with some brand new people that we brought on and it worked beautifully.

And we realize that all of the complexities and challenges and issues that we'd been having

was just because we need to get more focused on what the core of our code of honor was really about.

So in today's video, I'm doing a What's in My Backpack video.

And this was inspired by Keegan Acton

Because I was watching her video, and she said that every year people do these videos in like September, right before school starts,

but people don't do them throughout the year.

Which doesn't make sense, because what you have in your backpack on the first day of school, is not gonna be the same thing as what you have in your bag on the first day of Christmas break.

So in this video, I'm gonna show you guys what's in my backpack now that I've been in school for like four or five months, and now that i'm on Christmas break,

what did my backpack look like up until the last day of school?

Ah Canadian weather,

the most random thing on planet earth.

It's like sunny one minute, then pouring the next.

So I always have an umbrella, just in case.

Now how can you write notes or a test without a pen or a pencil?

And let's be honest, I'm that one person who always gets asked if I have an extra one handy.

At school, I always have my wallet with me because my friends and I go to lunch like three out of five days of the school week

and there are tons of vending machines on campus, so I'm not gonna be missing out on that either.

Sigh...

Because sometimes my book looks blurry, or the board is too far, and I have to just pop on those glasses and look like a dork

But I'm a pretty cute dork, so it's okay.

Now who else by midterms just can't find those papers, and have lost every single one you've had since the first day of school?

Me. So I use this folder to keep them organized.

Every college and university student knows the struggle of spending hundreds, and hundreds on books that you are going to look at twice.

But, you have to anyway, and this is just one of mine.

So I have a pretty unusual study method.

I will write all of my notes on a laptop, as opposed to notebooks, and then I will write all of my notes on a notepad to study for exams,

but only the stuff that i actually need, and not the random stuff your teachers make you write down.

Sorry boys, I don't decide when my period decides to come,

so I have to have these with me all the freaking time, just in case it decides to come.

There's always that on person that doesn't wear enough of this stuff, and everybody knows it.

I don't wanna be one of those people. So i wear this stuff and have it with me all the time.

One thing to know about girls, boys; is that every single one of them has that one hand cream that they will never get rid of, and never get tired of.

EOS hand cream happens to be mine.

So you know how that one person becomes a drug dealer the second they open up a gum or mint packet?

That person is me. That's always been me.

Not a day goes by that not one person asks me if I have an extra pen or pencil.

At this point, I have extras every single day, everywhere I go.

Do you have any idea how many germs cover a college campus?

I don't, and I really don't want to. But I have sanitizer just in case.

So we're nearing cold and flu season,

and this girl is not getting sick during finals.

So I have these cough drops just in case.

So my keys double as a utility, and a weapon.

Because I have a swiss army knife on mine. Because I go to school downtown,

and I need to be protected.

But in Canada, we can't have pepper spray.

so this is the next best thing.

Iron, an essential mineral that helps to transport oxygen throughout the body, comes in two dietary

Heme iron is found in animal food sources such as red meat, fish and poultry, which

originally contained hemoglobin.

According to WebMD, heme sources are where the body absorbs the most iron.

But for those who follow vegetarian or vegan diets, or others who may simply want to cut

back on their meat intake, their iron intake needs to come from other foods.

Understanding what non-heme, or plant-based, sources of iron are available—like these

eight—is essential to ensuring proper intake each day.

1.

Tofu

Made from soybean curds, tofu packs a serious nutrient punch!

Just half a cup contains 10 grams of protein and 44 percent of a person's daily calcium

needs.

It is also among the best plant-based sources of iron, with 6.4 milligrams in the same serving

size.

While tofu often has a reputation of being quite bland, it is a very versatile food that

absorbs the flavors of any dish it's in.

It is most commonly used in stir-fries, but is also great in soups, scrambled like eggs,

or marinated and grilled on the BBQ.

Pumpkin Seeds

The seeds of a pumpkin are commonly scooped out and discarded during the preparation process.

But you may want to think twice the next time you're carving a Jack-o-lantern or making

a pie from scratch, as the seeds are a great source of iron; just a small handful (approximately

one ounce) contains 4.2 milligrams.

While they provide the most benefit when consumed raw, roasting them for less than 15-20 minutes

will still preserve much of the nutritional benefits.

Quinoa is the "it" grain of the moment, and for good reason.

It is a natural source of B-vitamins, magnesium, phosphorus, potassium, calcium, vitamin E

and fiber, among other nutrients.

It also offers a valuable amount of iron—four milligrams per half-cup serving.

a complete protein, containing all nine essential amino acids," making it an especially nutritious

food source for those who follow meat-free diets.

Soybeans are among the best sources of iron, with 8.8 milligrams per one-cup serving.

The same serving size of lima beans contains 4.5 milligrams, while kidney beans have 3.9

milligrams, and both black and pinto beans offer 3.6 milligrams.

Peas and lentils, which are often grouped with beans, are also good sources of iron.

Cooked chickpeas, for instance, contain 4.7 milligrams per one-cup serving, while black-eyed

peas have 4.3 milligrams.

The same amount of lentils offers a whopping 6.6 milligrams.

Greens

Leafy greens—including spinach, Swiss chard, turnip greens, beet greens and bok choy—are

also rich sources of iron.

Cooking these vegetables is especially beneficial, as the process increases their iron content.

With 6.4 milligrams per one-cup serving, cooked spinach offers the most, but Swiss chard (4

milligrams), turnip greens (3.2 milligrams), beet greens (2.7 milligrams) and bok choy

with (1.8 milligrams) are nutritious alternatives.

Other green vegetables like peas, broccoli and Brussels sprouts range in their iron content

from 0.9-2.5 milligrams per half-cup serving.

Green vegetables are an especially important part of a diet because, in addition to their

rich iron content, they also contain high levels of vitamin C, which helps the body

to absorb the food's iron content.

Tomato Paste

While raw tomatoes are an insignificant source of iron, in a dried or concentrated form they

contain much more.

A half-cup serving of tomato paste has 3.9 milligrams of iron, and a similar portion

size of sundried tomatoes ranges from 1.3-2.5 milligrams.

As a sauce, one cup of tomatoes offers 1.9 milligrams of iron.

As with green vegetables, tomatoes are also an excellent source of vitamin C, helping

to ensure the body absorbs the iron it needs.

They also contain lycopene, an antioxidant linked to a reduced risk of various forms

of cancer.

8.

Nuts

Another great snack option for boosting your iron intake is nuts, particularly almonds,

cashews, pine nuts and macadamia nuts.

These varieties offer between 1-1.6 milligrams of iron per small handful (approximately one

ounce).

Nuts also contain a variety of other nutrients, including protein, fiber and good fats, but

it's important to note that blanching or roasting them may damage their nutrients,

so be sure to opt for raw and unblanched options.
