Communication During a Breach of Contract - Duration: 4:43.
Hi I'm Reed Bloodworth an Orlando Florida attorney.
Since 2004 I've practiced business litigation commercial litigation and estate and trust
litigation.
Today I want to talk about communications I see parties make when they believe a breach
of contract has occurred.
When I say parties I mean the potential plaintiff and the potential defendant.
Often times when a potential breach has occurred the parties are very tempted to begin a series
of e-mail exchanges or telephone call exchanges.
Sometimes this can be helpful but sometimes it can be pretty damaging to your case.
So I just wanted to run through a few examples.
When a potential breach occurs typically it is the potential plaintiff who will notify
the potential defendant.
A very general example would be you know dear defendant the contract we have states that
you were to pay me $500 by the 15th.
You failed to make that payment.
Please make this payment immediately.
That type of communication is fine.
It is within the realm of the contract.
If it was an installment note or something of that nature it's calm it's collected
it is a factual statement.
As a potential defendant he may or she may respond that I don't owe that payment because
of some circumstance that has arisen or perhaps the potential defendant believes that the
potential plaintiff breached the contract and that's why there's no payment owed.
These communications are generally OK.
They do establish potential evidence for any lawsuit going forward and often times they
lock the parties in to their potential positions.
So some recommendations.
When there is a potential breach of contract any communications should be calm.
You do not want to immediately fire off a very nasty email or begin name calling or
make statements that you know are untrue because you don't want to open yourself up to some
other type of lawsuit.
And while it is okay for clients or the parties to exchange some communication maybe attempt
to work out the potential breach it would be very advisable for the parties to engage
counsel.
And before any communication is made between the parties ask the counsel for their advice.
Often times the attorney will give you information that will help you resolve the issue quicker
rather than going into multiple exchanges with each other.
Also often times involving an attorney it will encourage the other side to resolve this
matter.
If at some point the parties appear that there's just not going to be a resolution it's beneficial
to have already had counsel involved because they're aware of the situation and they'll
be able to immediately begin the lawsuit representing you.

Well the facts usually determine whether or not there is a breach of contract case.
Often times the first questions I ask my clients is what's the value at issue?
Is it a situation where you've lost a substantial sum or money or some very minor amount of
money?
Is it a situation where you need some type of injunction otherwise your business may
be very very damaged?
A lot of times that simple question is going to answer whether or not they should pursue
an action.
For example if you have a contract with someone and you believe it has been breached the result
of that breach is you're not paid $1,000.
You may in fact have a valid claim for breach of contract but this is not one that you may
not want to engage an attorney to handle.
That's because your attorney's fees are going to outweigh the value of the recovery
in many circumstances.
Additionally I often advise clients in those situations where it's a lawsuit for less
than $5,000 they can pursue that on their own in small claims court.
It's not a situation where an attorney is required.
There's a specific system set up in court for those smaller monetary amounts.
Now when you're facing a situation where you're owed $50,000 or $100,000 or millions
of dollars those are much more serious in nature.
Those are cases where it is very beneficial to have an attorney involved and those are
typically cases that you should pursue for a breach of contract.
The other types of cases where it's often times beneficial to pursue for a breach of
contract involve cases where you may need an injunction to stop someone from harming
your business.
There may not be a specific monetary amount at issue but your business could be harmed
to a degree that it may not recover but for getting some type of injunction.
Those are two primary cases where I would advise yes you have a cause of action for
breach of contract and yes you should pursue it.
So again the facts are going to determine what type of case you have what's the monetary
amount at issue but consult with an attorney.

Number 7: Skin on Demand Making your own human skin suit is tough work these days, what with

But thanks to a group of Spanish scientists this problem no longer exists, as they've
developed the world's first 3D bioprinter capable of producing fully-functional human
skin.
This printer was the result of collaboration between the University Carlos the Third de
Madrid and the less flamboyantly named BioDan Group who specialise in regenerative medicines.
Their material mimics the structure of skin using a layer of collagen-producing fibroblasts,
and it's so close to the real thing it can be used in a wide range of fields, such as

Institute, we may have just made one of the key discoveries in the fight

In Mid-January a protein was identified which is responsible for determining the length
of your telomeres, which is important, as this in turn dictates how quickly your cells
age and whether they're likely to mutate into cancer.
Telomeres are like your cell's little clocks, and this protein named TZAP could be seen
as some form of battery, determining how long the clock runs for.
If we can stretch your telomeres we may be able to delay the aging process, but if they're
unnaturally long they then begin to pose an increased cancer risk.
It's like riding a see saw with whirring blades above and a pit of sex-raptors beneath you
- you wanna aim for somewhere in the middle.
Thankfully, TZAP naturally prevents your telomeres growing too much by trimming them to keep
them nice and short, and a further understanding of how they do this could help us get rid

Today's recipe is sweet and Navratri special
I will be cooking "SABUDANNA KI KHEER" (Rice pudding using Tapioca Sago (Sabudana)).
People love having this sweet and it's frequently cooked during the fasting days of Navratri.
It's very tasty, easy and doesn't need much time to cook.

Take 1 bowl of sabudana (Tapioca Sago in English)
Soak it in water for half an hour
Add 4 bowls of milk to the pan (use the same bowl size which we used for soaking sabudana)
Also add, ½ cup of water
make sure when you boil milk, Milk should not stick to the bottom of the pan or else it will smell and taste bad.
After 1 Boil, reduce the heat of your stove to medium and keep stirring.
After a minute or so add the water soaked sabudana which we prepared before.
Lower down the heat of the stove and keep stirring
Make sure the milk didn't get stick to the bottom of the pan
Now we will add some sliced cashews, Pistachios, almonds, charoli (Chironji in Hindi), raisins etc.
Adding these dry fruits while boiling will add flavor to the milk instead of adding it to the end.
Add ½ teaspoon of "Cardamom powder) – it gives an awesome aroma to this dish.
If you want – you can also add Saffron (kesar in Hindi) in here too.
Add 1/3 cup of sugar (you can add sugar as per your taste).
Mix it well and keep stirring, Let it cook on low flame for few minutes.
As you can see, it's prepared and ready to serve.
You can garnish this dish with any dry fruits, I used pistachios, almonds and cashews for garnishing.

Seoul Fashion Week 2017 kicks off, with eye on expansion - Duration: 2:50.
It's that time of the year again... when Korea's fashionistas meet under one roof for Seoul
Fashion Week.
Designers and organizers are working overtime to dazzle buyers... and ensure Seoul garners
greater recognition as a leading city in global fashion.
Kim Min-ji shows us what's hot this season.
Korea's contemporary fashion industry is relatively young -- only dating back to the 1950s -- and
it has yet to attain global recognition.
But top notch Korean designers are moving up the ranks,... while also seeking to share
their expertise with the next generation.
Rubina Collection is one example.
The contemporary women's wear line started 37 years ago... and it recently launched a
second line with more dynamic pieces.... to expand its customer base.
"Fashion isn't something that happens in a year or two.
You have to keep working on it -- researching and trying new things.
But nowadays a lot of young people just jump into the industry and leave.
They need to have passion and get out there into the field if they want to succeed."
Rubina is one of over 60 brands taking center stage at this year's Seoul Fashion Week -- which
opened Tuesday with an array of cutting-edge designs and concepts for the coming fall and
winter season.
"The show is now its 17th year.
Its relative youth gives it an air of excitement and possibility,... but it's also that much
more important for the participation of more industry veterans as well as young designers...
to make the event a global attraction."
A growing number of foreign buyers and press are taking an interest in Korean fashion,...
but the country still has a tough road ahead.
"Fashion weeks generally need to attract between one- and two-thousand buyers to get business
going and be considered a success, but in Korea the figure is between 200 and 300.
That figure is growing, and we're in the process of expanding."
Another challenge is the Seoul event is later on the calendar than other major international
fashion weeks,... so buyers have already made the rounds of other events.
"At the end of the day, it's a festival.
There needs to be more events on the sidelines for greater participation.
If the media, the government, the private sector, the public all participate to create
a festive mood -- business will follow -- as more people will post information and it will
circulate."
Industry watchers say designers should also target markets where the Korean Wave is popular...
and the Korean brand will catch on both in Asia and around the world.

Lingering anti-Korean sentiment signals long-lasting shift in Korea-China relationship - Duration: 3:05.
It appears the Chinese public follows its government's lead in terms of its anti-Korean
sentiments over the deployment of a powerful piece of U.S. military hardware to Korean
soil.
Although the initial rage has subsided, the two countries' relationship could have been
damaged beyond the point of no return.
Kwon Jang-ho files this report from Beijing.
Flags torn up, cars smashed in, and boisterous protests - These were the images that were
coming from China earlier this month, in response to South Korea's decision to deploy the U.S.
missile defense system, THAAD.
Politicians and state media voiced strong condemnation towards Seoul, and it became
the the number one trending subject on Chinese social media.
For the roughly 300-thousand Koreans living in China, it has been a fraught and anxious
time, with rumors of discrimination and even physical attacks.
Long-time residents in Beijing say it's the most tense period they have ever experienced.
"In the last three to four years, especially because of the Korean wave, there were many
Chinese people who felt warmly towards Koreans.
But because that mood switched in an instant, it felt even more impactful."
However, despite initial fears, the Korean embassy in Beijing confirmed that thankfully
no major incident or injury has taken place so far.
"It's true that many Korean residents here are nervous.
So every day since the beginning of March, we've been in contact with local Korean communities,
student groups, as well as the Chinese authorities...but nothing has been reported."
The rhetoric out of Beijing has eased in recent days, and attacks on social media have dissipated
as well.
Korean residents cautiously believe things are steadily going back to normal, but there's
now a distance in the Chinese public's attitude towards Korea.
"I think Korean leaders made the wrong decision.
They didnt consider our feelings and I'm upset.
We all want peace not war, but the fact that they came out like this really makes me angry
and incensed."
"I used to like Korea.
I used to use a lot of Korean products and visit Korea as well.
But after they did with THAAD, I can't do these things any more.
If I did, it would mean I would have no love for my country."
Can Korea and China's relationship ever go back to the way things were?
While THAAD is in Korea, China says no.
"The economic and cultural relationship could recover...
But the political and security issues cannot be resolved.
The only way out would be is if North Korea were to give up its nuclear weapons, meaning
there would be no need for THAAD.
But until then, this situation will not change."
"The height of the anti-Korean sentiment seems to have passed...for now.
But resentment remains.
And with the THAAD deployment still to come, the previously close Korea-China relationship
may never be quite so warm again.

Communication During a Breach of Contract - Duration: 4:43.Hi I'm Reed Bloodworth an Orlando Florida attorney.
Since 2004 I've practiced business litigation commercial litigation and estate and trust
litigation.
Today I want to talk about communications I see parties make when they believe a breach
of contract has occurred.
When I say parties I mean the potential plaintiff and the potential defendant.
Often times when a potential breach has occurred the parties are very tempted to begin a series
of e-mail exchanges or telephone call exchanges.
Sometimes this can be helpful but sometimes it can be pretty damaging to your case.
So I just wanted to run through a few examples.
When a potential breach occurs typically it is the potential plaintiff who will notify
the potential defendant.
A very general example would be you know dear defendant the contract we have states that
you were to pay me $500 by the 15th.
You failed to make that payment.
Please make this payment immediately.
That type of communication is fine.
It is within the realm of the contract.
If it was an installment note or something of that nature it's calm it's collected
it is a factual statement.
As a potential defendant he may or she may respond that I don't owe that payment because
of some circumstance that has arisen or perhaps the potential defendant believes that the
potential plaintiff breached the contract and that's why there's no payment owed.
These communications are generally OK.
They do establish potential evidence for any lawsuit going forward and often times they
lock the parties in to their potential positions.
So some recommendations.
When there is a potential breach of contract any communications should be calm.
You do not want to immediately fire off a very nasty email or begin name calling or
make statements that you know are untrue because you don't want to open yourself up to some
other type of lawsuit.
And while it is okay for clients or the parties to exchange some communication maybe attempt
to work out the potential breach it would be very advisable for the parties to engage
counsel.
And before any communication is made between the parties ask the counsel for their advice.
Often times the attorney will give you information that will help you resolve the issue quicker
rather than going into multiple exchanges with each other.
Also often times involving an attorney it will encourage the other side to resolve this
matter.
If at some point the parties appear that there's just not going to be a resolution it's beneficial
to have already had counsel involved because they're aware of the situation and they'll
be able to immediately begin the lawsuit representing you.

Do You Have a Breach of Contract Case? - Duration: 3:48.Hi.
I'm Reed Bloodworth an Orlando Florida attorney.
I've practiced business and commercial litigation and estate and trust litigation since 2004.
I'm often asked by clients potential clients if they had a breach of contract case.
Well the facts usually determine whether or not there is a breach of contract case.
Often times the first questions I ask my clients is what's the value at issue?
Is it a situation where you've lost a substantial sum or money or some very minor amount of
money?
Is it a situation where you need some type of injunction otherwise your business may
be very very damaged?
A lot of times that simple question is going to answer whether or not they should pursue
an action.
For example if you have a contract with someone and you believe it has been breached the result
of that breach is you're not paid $1,000.
You may in fact have a valid claim for breach of contract but this is not one that you may
not want to engage an attorney to handle.
That's because your attorney's fees are going to outweigh the value of the recovery
in many circumstances.
Additionally I often advise clients in those situations where it's a lawsuit for less
than $5,000 they can pursue that on their own in small claims court.
It's not a situation where an attorney is required.
There's a specific system set up in court for those smaller monetary amounts.
Now when you're facing a situation where you're owed $50,000 or $100,000 or millions
of dollars those are much more serious in nature.
Those are cases where it is very beneficial to have an attorney involved and those are
typically cases that you should pursue for a breach of contract.
The other types of cases where it's often times beneficial to pursue for a breach of
contract involve cases where you may need an injunction to stop someone from harming
your business.
There may not be a specific monetary amount at issue but your business could be harmed
to a degree that it may not recover but for getting some type of injunction.
Those are two primary cases where I would advise yes you have a cause of action for
breach of contract and yes you should pursue it.
So again the facts are going to determine what type of case you have what's the monetary
amount at issue but consult with an attorney.
