COMM 6825 Multimedia Presentation - Duration: 5:21.

>> NARRATOR: Photo sharing sites such as Pintrest, Flickr, Tumblr and Instagram have led to a

staggering amount of photo availability, by one estimate, 500 million photographs are

shared every day.

The exponential growth of photo sharing has become a boon for appropriation artists such

as Jeff Koons and Richard Prince.

>> NARRATOR: Appropriation art, as defined by the Los Angeles Museum of Contemporary

Art, is the practice of creating a new work by taking a pre-existing image from another

context and combining that appropriated image with new ones.

>> NARRATOR: Though technological improvements to sourcing, sharing and manipulating images

has put appropriation art into mainstream culture, the art form is at least a century

old, evolving in part from Cubist artists' practice of incorporating newspapers, musical

scores, and drawing scraps in their work, creating new meaning from the displacement

and combination of these materials.

>> NARRATOR: Despite an increase in usable material for appropriation artists, courts

have struggled in consistently applying Copyright Law's doctrine of Fair Use and transformative

use, leading legal scholar Lawrence Lessing to lament, "Fair use in America simply means

the right to hire a lawyer."

>> NARRATOR: In these types of cases the same court can deliver different rulings even when

they are dealing with the same artist.

For example, in the 1992 case, Rogers v. Koons, Jeff Koons was sued for basing his sculpture

String of Puppies on an image of puppies he had appropriated from a greeting card.

The Second Circuit was so scathing in its refusal to see Koon's work as fair use that

he quickly settled two other cases after losing at the summary judgment stage.

>> NARRATOR: Fourteen years later in Blanch v. Koons, Koons was sued for the use of part

of a copyrighted ad image in a collage.

This time the Second Circuit deemed the use transformative.

Koons was no longer a sleazy "pirate" as the Second Circuit called him in the Rogers

ruling, instead the court explained Koon's clear conception of his reasons and his ability

to articulate those reasons eased their analysis in this case.

>> NARRATOR: These ambiguous and inconsistent court rulings have created a chilling effect

on appropriation artists.

In a survey commissioned by the College Art Association, artists reported being discouraged

from particular lines of creative inquiry or entire artistic genres – some even changed

their approach in response to copyright concerns.

>> NARRATOR: Even Jeff Koons said he changed his artistic approach and began doing collage

as a response to the early 1990s court rulings against him, believing the new approach would

provide better legal cover.

>> NARRATOR: A chilling effect is exactly what the Fair Use and transformative use doctrines

were intended to avoid, instead the inconsistent application by the courts has created what

Lawrence Lessing calls, a permission culture, where creators are forced to ask for permission

to use copyrighted material rather than rely on an affirmative defense of fair use.

>> NARRATOR: To help remedy this issue, three possible reforms, suggested by various legal

scholars, are proposed.

>> NARRATOR: First, appropriation art should be considered intrinsically transformative

under the Fair Use doctrine.

To avoid judges having to determine what is "art" one legal scholar recommends that

presumption of fair use apply only to visual arts defined under the Visual Artists' Rights

Act of 1990.

The act provides its protection only to paintings, drawings, prints, sculptures, and still photographic

images produced for exhibition only.

>> NARRATOR: One of the problems with current Copyright Law is its binary approach to infringement

– either an activity is an infringement attracting potentially significant penalties

or it is not an infringement, attracting no penalties.

>> NARRATOR: Some legal scholars have suggested an intermediate liability approach.

Where a fair use defense would exempt the defendant completely from liability, utilizing

a transformative use defense would result in an exemption from penalties and injunctive

relief.

However, it would require the defendant to evenly divide any profits made from the infringing

work with the plaintiff.

>> NARRATOR: The final proposed reform is the most robust, but also the most impractical.

Richard Chused, a professor at New York Law School, has suggested creating a pool of royalty

funds by taxing the sale of all digital equipment, computers, blank media, servers, smartphones,

tablets and more.

The money from the tax would be distributed through semi-public royalty-pooling organizations.

The Copyright Office would have the authority to issue regulations determining the tax rate.

>> NARRATOR: This royalty pool would not be unique, pooled royalties have been distributed

for decades through performance rights societies like Broadcast Music and Sound Exchange, as

well as under various pooling systems for cable and satellite television and for digital

audio recordings operated by the Copyright Office.

>> NARRATOR: Through payment of the tax for digital equipment - art appropriators and

other remixers would in essence be paying a fee for allowing them access and use of

copyrighted materials.

Much like a recording artist making a cover, they could do as they wished with online digital

materials.

>> NARRATOR: While none of the three proposed reforms is a panacea to the tension between

appropriation art and Copyright Law, they do at least offer a more consistent approach

to the issue and would alleviate the current scatter shot approach courts have taken.

>> NARRATOR: So, hopefully one day, taking this image and doing, this, or this to it,

won't result in an invitation to visit the inside of a courtroom.
