Bombshell Report Reveals Why Judge Acquitted St. Louis Cop Of Murder | Top Stories Today - Duration: 3:10.

The ongoing riots in St. Louis are predicated on the notion that former St. Louis police

officer Jason Stockley shot Anthony Lamar Smith in cold blood because of racial hostility.

This does not seem to be the case.

The judge in the case has issued a step-by-step decision outlining why Stockley was ultimately

acquitted, according to NY Post.

These insights seem to show that the idea that Stockley premeditated Smith's murder

is impossible and does not line up with the facts.

Stockley, who requested that he be tried by a judge rather than a jury, escaped the possibility

of spending the rest of his life prison.

Many of the protesters calling for Stockley's head believe that the fact that Stockley's

DNA was found on Smith's handgun implicates Stockley in the "planting of evidence."

These are the facts according to St. Louis Circuit Judge Timothy Wilson.

First of all, after police officers were called to inspect a drug deal going done in a restaurant's

parking lot, Smith, one of the vehicles in question, sped away and engaged in a high-speed

chase.

After ramming Smith's car, Officer Stockley fired five times at Smith after he saw Smith

grab or raise a silver revolver.

This gun was later found in Smith's car, but only Stockley's DNA was retrieved from

it.

Stockley testified that he removed the gun and unloaded it to make sure that the weapon

was safe, thus explaining why his DNA was found on the weapon.

Judge Wilson found that a full-sized revolver is too large to conceal in someone's pocket.

Conversely, if Stockley had concealed the revolver in his belt, the gun would have been

visible in the recording of the incident, which it isn't.

Both of these scenarios make the idea of planting evidence as unlikely.

Judge Wilson also said that it would be an "anomaly" for a suspected heroin dealer

like Smith to not carry a firearm.

Next, Stockley's explosive outburst before firing the killing shots, which have caused

a lot of controversy, have been chalked as the emotional outpouring of someone caught

in a highly dramatic situation.

The dashcam footage of the event shows Stockley saying, "[I'm]going to kill this (expletive),

don't you know it" seconds before unloading on Smith.

Judge Wilson wrote, "People say all kinds of things in the heat of the moment or while

in stressful situations, and whether Stockley's statement … constituted a real threat of

action or was a means of releasing tension has to be judged by his subsequent conduct."

Therefore, there is no evidence that Stockley's outburst indicates premeditation.

Despite all of this logic, violent protests in the city continued for a second night last

night.

Most, if not all of these protestors, chanted the usual pablum of "black lives matter"

and "white silence is violence."

If you look at Judge Wilson's ruling, it seems clear that the argument that Stockley

shot Smith in cold blood, then planted a gun on him is unfounded in fact or logic.

The rioters do not seem to have much interest in facts or logic either.

We immediately get all the medical records that pertain to what went on, from the beginning

to the end.

And we need to see what the initial presentation was.

What the beginning symptoms were.

Let's say you've got a cough that won't go away, and/or a lesion on your tongue, and

the doctor thinks it's just nothing.

And you are seen, and you're seen, and you're given medication, and you're treated conservatively.

And a year goes by.

Well, we need to look at those medical records to see if the signs and symptoms were there,

they were just ignored.

Then when we get to the point where we say, okay, the standard of care was—and we base

this not on what we think, it's based on what a medical professional thinks.

Who's in the same specialty that the physician was in.

So, we look at everything.

In terms of all of what went in the beginning through diagnosis.

Then we look at: what is it?

What is the diagnosis?

Is it something that's so aggressive that it doesn't really matter when this was diagnosed?

And a lot of times on medical malpractice cases, what people are looking for is their

right.

They're not really looking for money.

They're trying to keep other people from going through the same thing that they have.

So, and I hear that.

I have heard that for 36 years from people who think they have a medical malpractice

I did not know…

that… the intensity of working with the admin,

with your colleagues, with the students.

I think often times we have a very romantic view

of primary school teachers. Ahhh… you know. What do you do?

I'm a primary school teacher.

Ohhh… yes. Oh they're so cute. You have a great time with them,

and you like… Do you know what my day is like? You know,

let's be realistic here. You know I meet them at 8

o'clock in the morning, I set an agenda with them, boom, boom,

boom…

Even with my P2's if I was to teach I have

an agenda with them they've got to get this done… we do art…

they need to be able to do this… it is a follow through.

And you know another person might say,

I never thought about that way… often we see these

picture-perfect you know…

situations of, you know, the teacher reading a book and,

like, Oh we do that. But at the same time we discuss

and we think and you grow.

So I think, like I said, I don't think

I realized the intensity…

of the profession. So…

like I just cracked a joke earlier about summer holidays:

thank God we have them, but it's much needed, you know,

in terms of reviving us; in terms of inspiring us;

in terms of helping us grow as humans and not just

be robotic teachers. And I think

that's another thing…

as a new teacher…

and it was experience that taught me that…

that I needed to be a balanced person,

because if I'm stressed out as a teacher,

I'm not being effective.

And often times you think oh I have, you know, these 10

things I need to get done, well what happens if you only

get 6 done?

You'll still survive the day; the next will be there.

Do you see what I'm saying? But if I finish all 10

and I'm stressed out; tired the next day, I'm just

going to be cranky at my students and they're not going

to have a good day. I'm not going to have

a good day, then why bother doing all 10?

And I didn't realize that. I think experience

has taught me that, you know.

As a new teacher I did not realize that…

I didn't have to be perfect.

You want that perfect lesson plan, you want

that perfect class every single time. You want…

all hundred percent attention from the students all the time.

That not going to happen.

We're lucky to get 80 percent,

and we should be happy — if we got 80 percent, we're good,

we're good. And that's a day of celebration.

So I think being realistic that you are going to have — not so

good lessons even if you've planned pretty well.

You are not going to get 100 percent of everyone's attention

at all times. There is going to be that… someone dropping

their pencil just as you're about to explain something,

and it's okay and you just say, You all right? OK.

Let's continue. And the calmer and cooler you are about it,

the easier it is.

Again I've learned that through experience.

I wish I knew that back then.

Just because we have—we need to know the cause of death.

It's an awful time for the family and it's a hard discussion to have with them.

But another way that people know is because sometimes medical professionals, particularly

nurses, will say to a family, just off to the side quietly: you need to call a lawyer.

And sometimes, in fact, a fair amount of the time, people tell me that they called our

law firm because my name was given to them by a nurse at the hospital.

Or a doctor at the hospital.

Or somebody who knows of the work that we do.

So, you know, that's generally how people know.

It's when there's an unexpected outcome.

And it seems like the biggest hurdle for people is the intimidation factor of just taking

the step to call a lawyer.

Once you've told your employer, once you've gone to that first step, the first thing you

need to do after that is make sure you check out a panel of physicians.

Lots of employers will have this up someplace, we call it a pink sheet.

In Georgia, you may see it's a long, bigger than a normal sheet of paper.

It's usually pink in color and at the top it will say OCGA.

And under that there's going to be a lot of language about what to do in the event that

you get hurt.

But the key part you need to look for is there are lines down at the bottom, usually six

or seven.

And those have doctors listed on them.

And why that's important is because those are the doctors you get to choose from if

you're hurt.

No matter where your employer sends you, no matter what they tell you to do.

Your first choice can always be off that panel, without any approval from your employer.

You can choose your first and your second choice without approval from your employer

off that panel.

And that's important because when you get sent to an occupational facility, and you

receive treatment that first day, your employer is going to say that's your first choice off

the panel.

So, you've already lost that right to choose your own doctor just by going for emergency

treatment.

So, you need to be able to protect yourself from that in the event that you have a serious

injury.

And you need something more than what an occupational facility can provide.

a video in spanish but i couldn't do it because i was laughing too much but.. ill try

so the first thing i wanted to talk about is that.. my name is diana and im 14

and im barely starting my first year in highschool *struggles to say highschool in spanish lolol* lol idk

im doing school through my laptop because i ... really didn't like my public

school for alot of different reasons so hopefully i'll have more time to make videos now

school for a lot of different reasons so hopefully i'll have more time to make videos now

but what happens with me is that, when i make a video, i usually hate how they turn out

so i dont publish it but... ive made a lottttt of videos and they're

all in my computer but.... i honestly have no idea what to talk about, but i can speak spanish

and english. I learnt spanish before english because my mother wanted for me

to be able to speak more than one language so i learnt english in my year of

kindergarten and i have been speaking spanish at home with my mother so i could

keep learning more words and then english at school with my friends

and im also learning japanese, korean, italian,

french and romanian.. because i love learning languages and being able to

speak more and be able to speak to people all over the world... its something

that i adore, i actually have japanese homework that im not

doing because im making this video.. i really like reading, i love reading books

and i could stay hours and hours just sitting reading a book

or being in the bookstores that are full with books

but i also love going to old stores that are full with old books because of the smell... everything <333

it just feels nice to be there

i also really love watching movies, but i like movies that aren't

super popular. what i do is look for actors and actresses

that are really lovely or i like their fashion/looks or their backstories

and then i watch their movies and the ones they've worked on

the movies... yeah the movies. and thats how i find my movies

i also really love the avengers <3 i adore them. i really love

kpop. bts, exo, got7. i have so many favorites

if you want, i can make a video talking about it but in reality during my

videos i'll probably talk even for a second about something

kpop because i love it so much. my friends never

really hear me speak spanish. the only time they really hear me speaking

spanish is normally when my mom calls me and then i have to talk

to her in spanish. she speaks english perfectly, but out of

habit, its something i always end up doing

even though sometimes when i talk to my mom in spanish

i usually speak a mix of spanish and english because my life is a mix of spanish and english

thats why it's a little more difficult for me to make this video

because im not used to talking only english for such a long time

i get really nervous when i speak spanish

im not sure why and sometimes i forget how to say

words that ive known since i was like three

and im not sure if you guys can tell, but i do get really nervous (thats why ive been saying uhm so many times lmao)

and that normally happens as well when i talk to people i dont know and because

i havent sat down in front of a camera for a while i feel really odd

and i keep giggling because of how nervous i am.

but... lets see if i even upload this video honestly..

i think here is where i end the video. thank you so much for staying till the end even though

this video was really weird and i didnt know what to talk about.. but at least

hey guys welcome back it's Maddy Kay here and thank you for clicking on my

video so this is a cover of break of editions and I'm gonna show you so many

days were put into this song because I have folders at school now that are 15

minutes longer than usual um eight hours a day and then I have I'm gonna be

studying like aggro classes soon and me and Rebecca are chatting and we're

putting collabs and stuff so there's a lot going on right now and I hope take

care of my siblings sometimes this took a week to film because I had to film six

different parts and this is the seventh part now the first part I filmed the

actual song which is really loud in this which I did not want and that doesn't

work but I was really too lazy to go redo it and then I have six voices of

machining in this you can hear two of them really well and the other you know

four are pretty quiet and hard to hear so that was a little bit of a mishap and

I look like horrible right now I just got out of the shower a little bit ago i

bred in my hair and put it in a bun and I'm in PJs so excuse that and I'm yeah

so let's get on with it if you can't hear the music very well I've been

reading this for you

Two kids that were Mormon who were from Perry, Georgia.

Had gotten married in the temple in Atlanta.

So, this group of five kids were stopping at a stop light.

The guy that was driving the vehicle that was coming so fast behind them, was an employee

of a pharmaceuticals company.

And it was just his pattern in life, to just drive excessively fast.

We found that he had 19 speeding tickets prior to this event.

He hit them going an excess of 70 miles an hour.

And carried them through the intersection.

Totally demolished the rear of the car.

As a result of the impact, the best man, who was in the back seat in the right, was killed.

He was dead in the car.

The two bridesmaids, the one in the center and to the left, each suffered serious head

injuries.

It wasn't about, yeah you think well, why in the world does that go to trial?

value of what was lost.

This young man that was killed spoke four languages fluently.

His goal in life was to become a leader in his community and a leader in his faith.

And in fact, to become a person who would lead missions in other countries.

And inspire other kids to do the things that he was doing.

So, the case was all about corporate responsibility.

And about that company not enforcing, they had great policies, they just didn't enforce

them.

And they had never taken a car away from any employee.

We proved that they had like thousands of employees all over the world driving cars

based on these same policies.

And that never once had they taken, unless someone got a DUI, they're automatically

out of the car for that.

They never offered us more than 4.5 million dollars to settle that case.

And the jury went out.

Stayed out a couple of hours is all.

Came back and said that his life was worth 10 million dollars.
